This policy describes the types of information we may collect from you or that you may provide through the website www.divysci.com and all subdomains (our "Website") and our cloud-based communication analytics subscription software and services, including communication metrics and suggestions and the communication bot that integrates with your various virtual communication platforms that you opt-in to  (collectively, our “Software”) and our practices for collecting, using, maintaining, protecting, and disclosing that information. 

This policy applies to the information we collect: 

  • On this Website. 
  • Through our Software. 
  •  In email, text, and other electronic messages between you and the Company. 
  •  Through mobile and desktop applications that you may download from this Website, which provide dedicated non-browser-based interaction between you and the Company. 
  •  When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy. 

It does not apply to information collected by: 

  • Us offline or through any other means, including on any other website operated by Company or  any third party; or 
  • Any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Website or Software.

Children Under the Age of 16 

Our Website and Software are not intended for children under 16 years of age. No one under the age 16 may provide any information to or on the Website or Software. We do not knowingly collect personal information from children under 16.   • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization,  dissolution, or other sale or transfer of some or all of DivySci Software LLC's assets, whether as a  going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by DivySci Software LLC about our Website users is among the assets transferred. 
  •  To fulfill the purpose for which you provide it. 
  • For any other purpose disclosed by us when you provide the information. 
  • With your consent. 

We may also disclose your personal information: 

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request. 
  •  To enforce or apply our terms of use and other agreements, including for billing and collection purposes. 
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of  DivySci Software LLC, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction. 

Choices About How We Use and Disclose Your Information 

We strive to provide you with choices regarding the personal information you provide to us. We have  created mechanisms to provide you with the following control over your information:  

Tracking Technologies and Advertising. You can set your browser to refuse all or some browser  cookies or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe's website. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly. 

We do not control third parties’ collection or use of your information to serve interest-based advertising.  However, these third parties may provide you with ways to choose not to have your information collected

or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising  Initiative ("NAI") on the NAI's website.

Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter  603A may submit a request to hello@divysci.com. However, please know we do not currently sell data triggering that statute's opt-out requirements. 

Accessing and Correcting Your Information 

You can review and change your personal information by logging into the Website and/or Software and visiting your account profile page. 

You may also send us an email at hello@divysci.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. 

If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Website users.  Proper access and use of information provided on the Website, including User Contributions, is governed by our terms of use.

Your California Privacy Rights 

If you’re a California resident, California law requires us to provide you with some additional information about how we collect, use, and disclose your “personal information” (as defined in the California  Consumer Privacy Act (“CCPA”)). 

Throughout this privacy policy, we discuss in detail the specific pieces of personal information we collect from and about users, the sources of that information, and how we share it. Under the CCPA, we’re also required to provide you with the “categories” of personal information we collect and/or disclose for business purposes (as defined by applicable law). We may also use the categories of personal information for compliance with applicable laws and regulations, and we may aggregate the information we collect or de-identify the information to limit or prevent the identification of any particular user or device. 

If you’re a California resident, you may have certain rights. California law may permit you to request that  we: 

  • Provide access to and/or a copy of certain information we hold about you. 
  • Provide you a summary of the categories of personal information we have collected or disclosed about you in the last twelve months; the categories of sources of such information; the business or commercial purpose for collecting or selling your personal information; and the categories of third parties with whom we shared personal information. 
  • Delete certain information we have about you. 

You may have the right to receive information about the financial incentives that we offer to you (if any).  You also have the right not to be discriminated against (as provided for in applicable law) for exercising certain of your rights. Certain information may be exempt from such requests under applicable law. For example, we need certain types of information so that we can provide the Website and Software to you. If you ask us to delete it, you may no longer be able to access or use the Website and/or Software. 

To exercise these rights, you can:

  • Delete your personal information by deleting your account.  
  • You can also submit requests by submitting a support ticket or emailing hello@divysci.com. 

You’ll need to provide us with information sufficient to verify your identity before we can satisfy your request. To do so, you’ll need to log into your account or provide us with certain information regarding

yourself and/or your usage of the Website and/or Software. You can also designate an authorized agent to make a request on your behalf. To do so, you need to provide us with written authorization for the agent to act on your behalf. You will still need to verify your identity directly with us. 

The CCPA sets forth certain obligations for businesses that “sell” personal information. Based on the definition of “sell” under the CCPA and under current regulatory guidance, we don’t believe we engage in such activity and have not engaged in such activity in the past twelve months. We may allow third parties to collect certain information about your activity, for example through cookies, as explained in the section titled, “Information We Collect Through Automatic Data Collection Technologies” and you can control these cookies through browser settings and other controls. 

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Website or  Software that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. It is our policy to post any changes we make to our privacy policy on this page.
